AB 3088 Tenant, Homeowner, And Small Landlord Relief and Stabilization Act Of 2020

On August 31, 2020 this bill was signed into law and is intended to assist homeowners and renters financially impacted by the COVID-19 pandemic.

There are five key components:

  1. Protections from evictions
  2. Extensions of just-cause eviction rules through January 2021
  3. Expansion of Small Claims jurisdiction
  4. Limitations on local evictions moratoria
  5. New penalties for illegal lockouts

Four new judicial council forms were created:

  1. UD-101* Plaintiff’s Mandatory Cover Sheet and Supplemental Allegations—Unlawful Detainer
  2. UD-104 Cover Sheet for Declaration of Covid-19–Related Financial Distress
  3. UD-104(A) Attachment—Declaration of Covid-19–Related Financial Distress
  4. UD-105 Answer—Unlawful Detainer

The ‘Plaintiff’s Mandatory Cover Sheet’ is now mandatory. A plaintiff filing a complaint for unlawful detainer or requesting any court action in an unlawful detainer proceeding filed before October 5, 2020, must complete all sections of this form.
