Madera County SB 2 Fee and Exemption Requirements Update

Effective April 13, 2026:

Please ensure all agents and submitters are advised of the following regarding the SB 2 Fee and Exemptions:

  1. If documents are submitted to Madera County without an exemption and reason indicated, the SB 2 fee shall be collected.
    • The only exception may be documents submitted and recorded at the request of a state or local government entity wherein the recording is exempt from recording fees AND Government Code 27383 is cited on the face of the document and/or DTT is clearly paid.
  2. Failing to indicate a reason for exemption from the SB 2 fee (i.e. failing to check the box on the attached cover sheet or providing the applicable statutory subdivision, ex. GC 27388.1(a)(1)), does not automatically result in a recording rejection. Documents are rejected for recording insufficiencies – SB 2 exemptions are not recording requirements.
  3. It is the responsibility of each document preparer and submitter to verify that each document has the appropriate SB 2 fee exemption cited on the first page of each document prior to submission.
